1. Scope of Application
1.1
These General Terms and Conditions (GTC) apply to the use of the website (Turnout.ch) as well as to the business relationship between Turnout.ch and its customers, in the version valid and accessible at the time the website is accessed or an order is placed.
1.2
A customer is defined as any natural or legal person who maintains business relations with Turnout.ch. The GTC, delivery and payment terms, as well as the data protection provisions may be amended from time to time. Turnout.ch requests that these provisions be carefully reviewed each time the website is visited and each time an order is placed.
1.3
These GTC apply exclusively. Any conflicting, supplementary, or deviating terms require the express written confirmation of Turnout.ch in order to be valid. By using the Turnout.ch website or placing an order, the customer confirms full acceptance of these GTC, including the delivery and payment terms.
1.4
Should individual provisions of these GTC prove to be invalid or unenforceable, or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

The information on the Turnout.ch website includes details about products and services. Changes in prices, product ranges, and technical modifications are reserved. All information on Turnout.ch (product descriptions, images, videos, dimensions, and other details) is to be understood as approximate values only and does not constitute any assurance of characteristics or guarantees unless explicitly stated otherwise. Turnout.ch endeavors to provide all information on the Turnout.ch website accurately, completely, and up to date, but makes no express or implied warranty in this regard.

All offers on the Turnout.ch website are non-binding and are not to be understood as binding offers.
Turnout.ch cannot guarantee that the listed products will be available at the time of ordering. All information regarding availability and delivery times is therefore non-binding and subject to change at any time without notice.
2. Prices
2.1
Unless otherwise stated, the prices listed by Turnout.ch include statutory value-added tax (VAT) and any applicable advance recycling fees (ARF). Prices are net prices in Swiss francs (CHF).
Any shipping costs, unless otherwise specified, are charged additionally and must be paid by the customer. Shipping costs are shown separately during the ordering process.
Technical changes, errors, and misprints are reserved. In particular, Turnout.ch may change prices at any time without prior notice. Consulting and support services are not included in the sales prices.
3. Conclusion of Contract
3.1
The offers on the Turnout.ch website constitute a non-binding invitation to the customer to order products and/or services from Turnout.ch. By placing an order via the Turnout.ch website and accepting these GTC, the customer submits a legally binding offer to conclude a contract. Turnout.ch then sends an order confirmation by email, confirming receipt of the customer’s offer. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.
3.2
The contract is concluded as soon as Turnout.ch sends an acceptance declaration by email confirming the shipment of the ordered products or services.
Orders are shipped only after full payment has been received and provided that the goods are available.
3.3
If, after the conclusion of the contract, it becomes apparent that the ordered goods cannot be delivered or cannot be delivered in full, Turnout.ch is entitled to withdraw from the entire contract or from part of the contract. If payment has already been received, it will be refunded to the customer. If no payment has yet been made, the customer will be released from the obligation to pay. In such cases, Turnout.ch is not obliged to provide a replacement delivery.
4. Payment Methods and Retention of Title
4.1
The customer may use the payment methods specified during the ordering process.
Turnout.ch reserves the right to exclude customers from certain payment methods without stating reasons.
4.4
Deduction of Credit Card Fees in the Event of Refunds
If a customer cancels an order or exercises their right of withdrawal, Turnout.ch reserves the right to deduct the credit card fees incurred from the refund amount. This applies regardless of the reason for the refund unless otherwise agreed in writing. The deduction corresponds to the actual costs incurred by Turnout.ch due to the credit card fees.
5. Delivery, Inspection Obligation, Defect Notification, and Returns
5.1
Deliveries are made by post or courier service to the address specified by the customer in the order. Invoicing is carried out by email or by post. Upon dispatch, benefits and risks are transferred to the customer insofar as legally permissible.
If delivery is not possible or if the customer refuses to accept the delivery, Turnout.ch may terminate the contract after sending a notice of default by email and setting a reasonable deadline, and may charge the customer for the expenses incurred.
Once a delivery date has been agreed between the contact person and the supplier, the customer is obliged to ensure that the delivery can be accepted at the delivery address.
Unless otherwise agreed in advance, a responsible person must be present to accept the delivery.
If delivery cannot be completed because no person is available to accept it, or if other circumstances result in a second delivery, the additional costs must be borne by the customer.
A second delivery in such cases is mandatory and cannot be reversed.
If the customer does not wish to accept a second delivery, they must contact Turnout.ch in good time.
The customer remains obliged to pay the costs incurred for the return.
5.3
The customer is obliged to inspect the delivered goods immediately upon receipt and to report any defects for which Turnout.ch is liable without delay in writing by letter or email to info.turnout@gmail.com.
If one or more defects are identified, the item must not be used or washed without the consent of Turnout.ch (condition as delivered).
If the item is nevertheless used (worn or washed), Turnout.ch accepts no liability for any damage resulting from the defect.
Turnout.ch may also refuse to replace an item if the customer has knowingly used the defective item and caused a loss in value. In such cases, Turnout.ch may also assert a financial claim against the customer.
Returns to Turnout.ch are made at the customer’s expense and risk. The goods must be returned in their original packaging, complete with all accessories, together with the delivery note and a detailed description of the defects, to the return address specified by Turnout.ch via info.turnout@gmail.com.
5.4
If Turnout.ch determines upon inspection that the goods show no detectable defects or that the defects are not covered by warranty, Turnout.ch may charge the customer for the expenses incurred or for the return shipment.
5.5
Turnout.ch offers customized customer orders as a service, which are clearly and expressly agreed upon in writing with the customer in advance.
As these are custom-made items produced according to customer specifications, withdrawal or return after order confirmation is excluded.
Turnout.ch reserves the right to reject orders that are technically or creatively not feasible, or to adjust them in consultation with the customer.
6. Right of Withdrawal
6.1
The customer is granted a right of withdrawal for a period of 14 calendar days after receipt of the goods (excluding items made to customer specifications, except in the case of defects). The deadline is deemed met if the customer sends the written withdrawal by email (info.turnout@gmail.com) or by letter (Sägestrasse 1, 9506 Lommis) within the period. No justification is required.
6.2
Exercising the right of withdrawal results in a reversal of the contract. The customer must return the goods within 10 calendar days in their original packaging, unused, unworn, unwashed, complete with all accessories and the delivery note, to the return address specified by Turnout.ch (Sägestrasse 1, 9506 Lommis).
Returns are made at the customer’s expense and risk. Any payment already made will be refunded within 20 calendar days, provided that Turnout.ch has received the goods or the customer can provide proof of shipment. Please note that credit card fees may be deducted in the event of a refund (see section 4.4).
Turnout.ch reserves the right to demand reasonable compensation for damage, excessive wear, loss of value, or increased transport costs for the return delivery, and to deduct such amounts from the refunded purchase price or invoice them to the customer.
7. Warranty
7.1
Turnout.ch endeavors to deliver goods of flawless quality. It is at the discretion of Turnout.ch to provide warranty services in the form of free repair, equivalent replacement, or refund of the purchase price. Further claims are excluded.
Unless otherwise stated, a bring-in warranty applies.
Normal wear and tear, improper handling, damage caused by the customer or third parties, and defects attributable to external influences are excluded from warranty coverage.
Turnout.ch cannot provide assurances or guarantees regarding the timeliness, completeness, and accuracy of the data, nor the constant or uninterrupted availability of the website, its functionalities, integrated hyperlinks, and other content. In particular, it is neither assured nor guaranteed that the use of the website does not infringe third-party rights.
8. Liability
8.1
Turnout.ch excludes all liability, regardless of legal grounds, as well as claims for damages against Turnout.ch and any auxiliary persons or agents. In particular, Turnout.ch is not liable for indirect damages, consequential damages, lost profits, or other personal, material, or purely financial losses suffered by the customer. Mandatory statutory liability, for example in cases of gross negligence or unlawful intent, remains reserved.
9. Data Protection
9.1
Turnout.ch is entitled to process and use the data collected during the conclusion of the contract for the fulfillment of obligations arising from the purchase contract and for marketing purposes. For certain payment methods, customer data is forwarded to the payment service provider for invoicing or payment processing.
Data necessary for service fulfillment may also be passed on to commissioned service partners (logistics partners) or other third parties.
Third parties may use the data solely for order fulfillment and not for their own marketing purposes.
Turnout.ch excludes any liability for data security and for the use of data by third parties or partners.
The data may be shared and used in cooperation with external companies (logistics partners) for verification purposes.
10. Final Provisions
10.1
Turnout.ch expressly reserves the right to amend these GTC at any time and to bring them into force without prior notice.
In the event of disputes, substantive Swiss law shall apply exclusively, excluding conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.
The place of jurisdiction is Frauenfeld, unless mandatory statutory jurisdictions apply.
